Smarter Drafter Precedent Update August 2024

And that's a wrap. Check out all the new content that's been added to Smarter Drafter in the last month.

Welcome to the precedent update for August. This big update features new forms for the Federal Circuit and Family Court, QLD UCPR, along with updates to the Independent Contractor Agreement and new FLENA additions.

Federal Circuit and Family Court of Australia

New forms

We have significantly expanded our FCFCOA suite with the addition of the following forms:

  • Affidavit of proof of signature (non-divorce)
  • Affidavit proving signature (divorce)
  • Affidavit: Translation of Marriage Certificate
  • Application – Contempt
  • Application for Review
  • Application in an Appeal
  • Affidavit – Non-filing of family dispute resolution certificate
  • Certificate of dispute resolution
  • Notice of ceasing to act
  • Notice of objection – Subpoena
  • Notice of request to inspect
  • Notice to Admit
  • Request to attend by electronic communication
  • Response to an application in an appeal
  • Response to divorce
  • Subpoena

Amendments

In response to your feedback, we have amended the following FCFCOA forms to make document production process faster and easier:

  • Financial Statement – ‘repeat’ functionality has been added to the form for Properties and Businesses to enable the addition of up to 99 of each. We are working on adding further repeats and making more variables optional.
  • Affidavit (Family Law & Child Support) – swearing options and witness details are no longer mandatory in the form. We will be making these changes to all the FCFCOA affidavits in the coming weeks.
  • Application in a Proceeding – ‘repeat’ functionality has been added to Respondents to enable entry for a second respondent; fields for, Respondent contact details have been added.
  • Genuine Steps Certificate – amended to enable completion for either Applicant or Respondent.

 

Queensland UCPR

New forms

We have added the following forms to our suite of QLD UCPR forms:

  • Form 18 – Defence and counterclaim
  • Form 103 – Notice of intention to apply for a grant

 

Independent Contractor Agreement

Content Update

Changes to the Fair Work Act 2009 (Cth) that commenced on 26 August 2024 have significant implications for independent contractor arrangements and the rights of independent contractors. You can read more about the changes and the changes we have made to the Independent Contractor Agreement here.

 

Employment Contract

Content Update

Our ‘Employment Contract – Superseded’ has now been retired. Many of you have already used our ‘new’ Employment Contract – if you have any issues or comments, please let us know.
