Smarter Drafter Precedent Update February 2025

Check out all the new content that's been added to Smarter Drafter in the last month.

Welcome to the precedent update for February. This update features amendments to Estate Planning precedents and the Unit Trust Deed, new Court Forms, and minor adjustments to other documents.

Content update: Estate Planning

Last Will and Testament
  • Use and disposal of body – options to insert provisions expressing a testator’s wishes for burial, cremation and/or organ donation have now been included in all Smarter Drafter wills:
    • Last Will and Testament (short-form)
    • 1 x Simple Will
    • Express Mirror Wills
    • Express Will – All to Children
    • Express Will – All to one beneficiary
    • 2 x Standard Mirror Wills (for couple)
    • 2 x Smarter Mirror Wills (for couple)
    • 1 x Standard Will (All to Children)
    • 1 x Smarter Will (All to Children)
  • Backsheet / Letter to client – options to create a will backsheet for all jurisdictions and an accompanying letter to client have been inserted in the following Smarter Drafter wills:
    • Last Will and Testament (short-form)
    • Express Mirror Wills
    • Express Will – All to Children
    • Express Will – All to one beneficiary

Content update: Trusts

Unit Trust Deed
  • Options regarding the initial allotment of units have now been included. You can now:
    • include details of initial unitholders
    • provide for allotment by subscription – a pro forma subscription application will be included
    • include a provision for the Trustee to be able to allot units in its discretion

Content update: Court Forms

Federal Circuit and Family Court of Australia
  • NEW – Financial Statement “Express” – a new version of the Financial Statement that allows you to produce a document without completing every item of information
