Welcome to the precedent update for November. This update features amendments to Federal Circuit Court and Family Court forms, Estate Planning precedents, and more, plus a new Client Questionnaire for Commercial transactions.

Content update: Federal Circuit and Family Court of Australia

New forms

The following form has been added:

  • Response to an initiating application

Form updates

Our review of the forms to ensure consistency across the suite has continued this month. The following forms have been updated:

  • Financial questionnaire
  • Genuine steps certificate
  • Initiating application
  • Outline of Case Document (Interim Hearing)

Content update: Court Forms

The following forms have been amended:

  • Probate Kit (Qld) – affidavits amended to insert deponent and witness signing placeholders on each page except the last

Content update: Estate Planning

In response to your feedback, we have been working through our Will precedents to show testator, executor, and beneficiary names in bold caps so that they stand out for clients when they are reading the documents. The following Wills have been amended:

  • Last Will and testament (long-form)
  • Express Mirror Wills (also amended to output the first name of spouse/partner throughout eg “my husband JOHN” instead of “My Spouse”)
  • Express Will – all to children

Content update: New Client Questionnaires

With our New Client Questionnaires, you can easily collect comprehensive information on new clients and their matters. Our questionnaires can be sent as intake forms or they can be embedded on your website, in either case to be completed by new clients themselves. Contact us if you need any assistance or would like to know more.

Questionnaires are available for:

  • (NEW) Commercial (available in our Commercial suite of documents)
  • Estate Planning (amended this month to improve ease of use where no children and no marriage or defacto relationship)
  • Family Law (amended this month to link client answers for name/email/mobile number to initial data entered in the form)

Content update: Other

Minor amendments have also been made to the following documents:

  • Appointment of Enduring Guardian (NSW)
  • Deed of Guarantee
  • Employment Contract
  • Legal Services Agreement (NSW/VIC/WA)
  • Family Law Checklist (FLENA subscribers only)
